CodeJungle Terms of Service

We are CodeJungle sp. z o.o., a company under laws of Poland, with registered address at: Stanisława Sojczyńskiego 8, 42-141 Przystajń, Poland CodeJungle" or "CJ" or "We" or "Us"), is a developer and publisher of games and mobile game applications that are made available via app stores including the Apple Application Store and Google Play Store (our "Games").

1. About

By downloading one of our Games, you accept this Agreement and our Privacy Policy. By using or otherwise accessing the Services, you agree to the Agreement. If you do not agree to this Agreement and our Privacy Policy, you may not use or otherwise access the Services. Make sure that you read them carefully before using the Services (our Games). You represent that you are at least 16 years old. If you are under age 16, you may not use our Services. If you are between the ages of 16 and 18, you represent that your legal guardian has reviewed and agrees to the Terms and our Privacy Policy. If your child wishes to use our Services, you as a child's legal guardian must agree to these Terms and our Privacy Policy as a precondition to the child's use. You represent that you are accessing our Games as a private person. Any commercial use of our Games is not allowed.

2. End-User License Agreement

Subject to these Terms of Service, CodeJungle grants you a non-exclusive, non-transferrable, non-sublicensable, limited right to use our Services for your own personal, non-commercial, entertainment purposes. Games provided to you are licensed to you and not sold. CodeJungle own all right, the apps itself, and all the trade marks, copyright, database rights and other intellectual property rights, still belong to CodeJungle. The rights granted to you in this Agreement are subject to the following restrictions:

you shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit any Game
you shall not modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of Games, except to the extent the foregoing restrictions are expressly prohibited by applicable law
you shall not access any Game in order to build a similar or competitive service or application
you shall not remove or destroy any copyright notices or other proprietary markings contained on or in any Game
you shall not use bugs or exploits in any our Game to gain benefits
you shall not sell virtual goods or accounts in any our Game for real money

All attempts to exploit bugs in our Games, violate ToS or violate social rules will result in irretrievable account deletion.

3. Purchases in the Services

Your purchases of Virtual Currency and/or Virtual Goods, which you may purchase with "real world" money or which you may earn via gameplay, is final and is not refundable, exchangeable, transferable. Virtual Items are licensed to you on limited, personal, non-transferable, non-sublicensable and revocable basis and limited only for non-commercial use.
You may not purchase, sell, or exchange Virtual Currency or Virtual Goods outside the services.
CodeJungle may control, manage and modify or eliminate Virtual Items at any time, with or without notice.
Virtual Items do not have an equivalent value in real cash and do not act as a substitute for real world money. Neither CodeJungle nor any other person or entity has any obligation to exchange Virtual Items for anything of value. CodeJungle has no liability for hacking or loss of your Virtual Items.

4. Privacy

Our ads suppliers use your personal data to personalise ads for you. We use third-party analytics provider for the purposes of delivering our services, conducting analysis, and research. Please read our Privacy Policy.
If you send requests to us we collect and process the data from you in order to be able to provide a response. For the support purpose, it may be necessary for you to provide us with information about your end device so that we can resolve some technical problems. The informations are voluntary. You are free to send the request to us under a pseudonym.
We collect this data in order to provide our app to you and to be able to process your request.

5. Indemnity

You agree to defend, indemnify and hold harmless CodeJungle from and against any claims, suits, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) brought by third parties resulting from or relating to your use of any Game or your violation of this Agreement.

6. Third-Party Services

CodeJungle may permit certain third-party applications (like leaderboards, game networks) to provide content through the Game ("Third Party Services"). The Game may be used to send content provided by the Third-Party Service between users who have the Third-Party Service installed on their device. When you do so, CodeJungle will share information with the Third-Party Service as described in the CodeJungle Privacy Policy. CodeJungle is not responsible for and does not control Third-Party Services. CodeJungle provides these Third-Party Services only as a convenience to you. CodeJungle has no obligation to review or monitor and does not approve, endorse, or make any representations or warranties with respect to Third-Party Services. You use all Third-Party Services at your own risk. When you access a Third-Party Service, the applicable third party's terms and policies apply, including the third party's privacy policies. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction in connection with any Third-Party Service.

7. Availability of the Services

You understand and agree that our Services may be terminated (or partly terminated) without notice to you (including for example economic reasons due to a limited number of users continuing to make use of them over time). In such an event we do not have to provide refunds for Virtual Items or other items in connection with such discontinued Services.
We promise to provide our Services in accordance with highest professional standards.

8. Limitations of Liability

The service is provided "as is" without any further warranties or any kind. You understand that our Services cannot be guaranteed as error free.
You assume the risk of any and. For minor users, the responsibility rests with their legal representatives.
CodeJungle won't be liable for special, incidental or consequential damages or loss from use of, or inability to use, the Services, including but not limited to, damages to property, loss of goodwill, device failure or malfunction and, personal injuries, lost profits cause by the action arising out of the Services.

9. Epilepsy

Any person who suffers from epilepsy must consult a doctor before playing. If you experience uncontrollable jerking movements, impaired vision, dizziness, muscular or visual spasms, loss of consciousness, disorientation, involuntary movements, or convulsions whilst playing, stop playing immediately and consult your doctor.

10. Changes to these Terms of Service

We may update our Terms of Service from time to time. We will notify you of any changes by posting the new Terms of Service on this page.
You are advised to review this Terms of Service periodically for any changes. Any changes to this Terms of Service will be effective upon the earlier of thirty (30) calendar days following our dispatch of an e-mail notice to you (if applicable) or thirty (30) calendar days after they are posted on this page. These changes will be effective immediately for new users of our Service. Continued use of our Service following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes. The date on which the latest update was made is indicated at the top of this page.

11. Legal Compliance

You represent and warrant that
- you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
- you are not listed on any U.S. Government list of prohibited or restricted parties.

12. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using a Game.
